Welcome to Rose Mill Company’s web site. If you visit our web site, purchase from us by fax/phone/email, or purchase online, you accept these conditions. Please read them carefully. ​

Privacy

Rose Mill Company does not sell your information to third-party vendors. We may, from time-to-time, send an email or electronic communication regarding important information (such as a change in our policies, a change in our operating hours due to a storm, or an update to our pricing or delivery schedule). There is an opt-out link available in all emails sent.

Electronic Communications

When you visit Rose Mill Company or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Trademarks

Rose Mill Company trademarks may not be used in connection with any product or service that is not Rose Mill Company’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Rose Mill Company. All other trademarks not owned by Rose Mill Company or its subsidiaries that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Rose Mill Company or its subsidiaries.

All Sales Are Final

In order to comply with Rose Mill Company’s ISO 9001 quality procedures, we cannot accept returns for products that have left our premises. Materials that have left our premises may have been subjected to unknown storage and handling conditions, and Rose Mill Company cannot re-sell or reuse products with questionable quality. Therefore, all sales are final.

Returns for defective items or wrong shipped items may be refunded or exchanged by contacting Rose Mill Company in advance (please do not return items without approval from Rose Mill Company). Items damaged in transit may be refunded if shipped and pre-paid by a Rose Mill Company selected carrier. If you choose to use your own carrier and/or pay for your own freight, then you must negotiate any damage/loss with your carrier. You are responsible for full payment to Rose Mill Company (please see our shipping policy for details).

Rose Mill Company Shipping & Receiving Policy

Thank you for choosing to do business with Rose Mill Company. We provide competitive freight rates for materials shipped to and from our facilities. Rose Mill ships millions of pounds in the U.S.A. and globally, and have secured favorable rates with trusted carriers. It is our preference to arrange freight on a “pre-pay and add” basis.

Customers are also welcome to use their own freight carriers or parcel shipping accounts. Customers that choose to use their own freight or parcel carrier are responsible for the scheduling, paperwork and quality of services:

• Freight Scheduling – customers must arrange pickup with their preferred carrier
• Freight Paperwork – customers must provide a Bill of Lading to Rose Mill prior to the scheduled pickup
• Freight & Parcel Shipping Quality – claims arising from damages caused in-transit must be negotiated between you and your carrier

IMPORTANT- You are responsible for full payment once items leave our warehouse on your carrier. Rose Mill has no standing with your shipper and cannot argue claims on your behalf. Unless damages are noted in writing by your carrier at time of pickup, Rose Mill is due payment for all items shipped. Any losses must be negotiated directly between you and your carrier. Choosing to use your own carrier is also choosing to accept liability for material in-transit to your destination. Please consider this liability when deciding to use your own carrier.

Our shipping hours are:

Monday-Friday 8:00am to 3:30pm EST (not including holidays).

License and Site Access

Rose Mill Company grants you a limited license to access and make use of this site and not to download or modify it, or any portion of it, except with express written consent of Rose Mill Company. This license does not include any resale or commercial use of this site or its contents: any collection and use of any product listings, descriptions, or prices: any derivative use of this site or its contents: any downloading or copying of account information for the benefit of another merchant: or any use of data mining, robots, or similar data gathering and extraction tools. Applicable Law

Disputes

Any dispute relating in any way to your visit to Rose Mill Company or to products you purchase through Rose Mill Company shall be submitted to confidential arbitration in Connecticut, USA, except that, to the extent you have in any manner violated or threatened to violate Rose Mill Company’s intellectual property rights, Rose Mill Company may seek injunctive or other appropriate relief in any state or federal court in the state of Connecticut, USA, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
